Important Questions To Ask Your Home Inspector.

You know when you are buying a home, that you will need a home inspection.  But when it comes time to read the inspection report you feel like you need a translator!  Here are a few important questions you should definitely ask your home inspector to help you understand the inspection report before closing the deal.

1.  Clarify what is truly bad.  Have the inspector tell you exactly what is really bad, what will need to be fixed right away and what can wait.  Also,  have him let you know what he put in the report that he just wanted to let you know about, but was not a necessary repair.  This is important because the inspector may have something noted under the category “Health & Safety Hazards” and all it is a small plumbing issue that would only cost a few dollars to fix.  So it is important to clarify everything.

2   How hard is that to fix?  You should ask the inspector how something should be fixed and they will usually be more than happy to explain to you how easy the repair is to do yourself.  If it is not a simple fix, they may have someone they can refer to you to have the repair done professionally.  Additionally, they can also tell you about how much the repair should cost, whether you do the repair yourself or have it done professionally.  This information can be invaluable when you are not sure about a particular repair.

3.  If it were you, what would you do?  Ask the home inspector what they think you should have fixed or not fixed, whatever the case may be.  It is the home inspectors job to point out every little thing in their report.  That’s what you are paying them for remember.  So find out what is and isn’t a necessary fix.

4.  Get clarification on anything you don’t understand.  Sometimes the inspection report contains a term or a repair that you have no clue what they are referring to.  Ask the inspector to show you each and every item on the report that does not make sense.  It is going to be your new home for years to come and you need to understand everything about it.

5.  How does that work?  There will inevitably be one or maybe several mechanical systems that you don’t know how to work.  Most home inspectors would be more than happy to show you how to operate everything.  But you have to ask.  So go through the entire house and make a list of everything you think you may need help with – then ask.

The home inspection is one of the most important things you will be doing when buying a new home.  Finding out any major defects etc. could keep you from buying a money pit or could help you to renegotiate the deal if many repairs are needed.  Get your realtor involved in the process.  Your agent sees hundreds of homes every year and you might be quite surprised at what they can point out before you even begin the inspection process.

Mortgage Debt Settlement Risks You Should Know.  Buying a home is a wonderful feeling and there are several ways to purchase a home:  cash, rent to own or by entering into a mortgage.  Most people opt for a mortgage and for very good reason.  A mortgage is a good way to establish a good credit history and because it is the fastest way to buy a home.  Cash takes a long time to save; whereas, a mortgage will get you into your new home almost immediately.

There are many things to consider when deciding to purchase a mortgage.  Handling your debt properly now and into the future should be your first priority because a mortgage debt that has gotten out of control can have very serious repercussions for the home owner.  So make sure you think about your long term plans and goals before deciding on how much of a mortgage you can handle.

4.Beware Of A Possible Lawsuit – Lawsuits are very common in debt settlement cases.  It does not matter what your situation is or how it came to be; lenders will not adjust your loan to meet your current financial problems.   So remember you can be sued for not paying your debt in full.  In addition,  this will have a negative impact on your credit history.

Tips to get  your home sold.  Do you know what your homes “Hot Buttons” are?  We all know that location plays an important role in the sale of a home but there are several things that your home may have that you are not highlighting.

Here are a few things that you may not have thought of that you can use as “Hot Buttons” to help get your home sold more quickly.

• Everyone has their favorite places that they frequent – convenience places – such as the neighborhood Walmart, Costco, Home Depot or the closest Daycare Center  etc.  So make sure that you let your realtor know about the things that people may be looking for and ask your realtor to include them in all of the print material

• Is your home within walking distance to any neighborhood shopping districts?  The ones with the highly sought after hang outs like Starbucks etc.  Walk “Scores” are a huge part of a buyers decision as to whether they will buy a home or not.

• Bookshelves, nooks and storage spaces are also big time necessities for most people.  Especially for apartment dwellers that are bursting at the seams due to the lack of these things.  So make sure you let your realtor know about each of these spaces that could be a huge selling point for many people.  Additionally, you are going to want to do everything possible to highlight these spaces with decor that will show off that particular use of space.

• Is your home dark?  Consider removing the curtains or that old shade.  This will make the space look lighter and brighter in the eyes of a buyer.  A light, bright space has a positive emotional impact on people when they walk into a room so do everything you can to lighten your dark spaces with as much natural light as possible.

• Do you have a patio, deck, back yard or porch of any kind?  Many buyers, especially people who have been living in an apartment and have not had the pleasure of having an outdoor living space, will have those things on their list of must haves.  So if you have an outdoor living space, it would benefit you greatly to stage those areas.  Accent them and make them as appealing as possible to your potential buyer.  You want to have your potential buyer envisioning themselves using those spaces on a daily basis.  Sometimes if your outdoor spaces are extremely desirable, the buyer will overlook some imperfections on the inside just because the outdoor spaces are everything they have ever wanted.  A well staged outdoor space can also bring in higher offers.

• Let your potential buyers know if there is anything that you would be willing to leave in the house.  Such as the refrigerator, washer, dryer, a patio set etc.  These are the items that are hard to move and many people do not have one of their own and on moving day the last thing your buyer wants to think about is having to go out and purchase an appliance just to be able to live in their new home.

Talk to your realtor about all of the little things you can do to get your home sold quickly and for top dollar.  Your realtor has been doing this for years and will have many tricks up their sleeves so take advantage of all that experience and let them do everything they can to help you sell your home!

Things To Check Before Moving Into A Neighborhood.  Buying a home is a very exciting time but you need to be diligent and do your research very thoroughly.  You may be spending the rest of your life living in this neighborhood.  Doesn’t it make sense to spend a significant amount of time checking it out first?  Here are a few things you must check before signing on the dotted line.

1.  Check The Crime Stats – Don’t assume you know whether or not it is a good neighborhood.  Check the sex offender registry.  Google your address – you may find out that your house was once a meth lab or worse.  Check the crime maps for the area, you may be very surprised at what you find.

2.  How Recession Proof Is The Neighborhood – Is the neighborhood in good proximity to job opportunities.  Is it an area that has a multitude of subprime loans that could result in default and leave the neighborhood with a huge supply and no demand.  Look for a more than normal amount of “For Sale” signs or foreclosure notices on the windows.  Check to see if all of the homes for sale in the area all have major price reductions or if it costs less to buy than to rent.  All of these are good indicators that this is a pretty hard hit area and you may need to think twice.  However, on the same note, you will find some great deals here as well.  So if you are in it for the long haul you should be alright.  You just don’t want to get stuck in an upside down home if you end up needing to sell quickly.

3.  Does The Area Match Your Needs – Does the neighborhood have the types of things your enjoy, such as your hobbies, hot spots you like to frequent, parks and recreation, your favorite restaurants.

4.  Does The Area Have Your Necessities – Are your favorite grocery stores available or how far would you have to drive to get to them.  Is daycare close by.  What about the gym and the nail salon etc.

5.  Check The Neighborhood At Different Times Of The Day And Night – This is probably up there with one of the most important things you need to check.  Sometimes a neighborhood will look perfectly normal during the day; however, a drive through during the night exposes a whole other element that you would definitely not want to live around.

These are just a few things that you need to check now and again before you sign your mortgage paperwork because neighborhood dynamics can change quickly and frequently.  The very best way to help avoid a big mistake is to talk to your realtor.  Your realtor has access to all of this information at their fingertips and they would be more than happy to help you get your ducks in a row before you commit to one of the biggest decisions of your life.

How To Save On Your Taxes Using The IRS Code 1031 Exchange.  What exactly is the 1031 Exchange and how does it work?  Well let’s first define 1031 Exchange.

1031 Exchange:  “no gain or loss shall be recognized on the exchange of property held for productive use in a trade or business or for investment, if such property is exchanged solely for property of the like kind, which is to be held either for productive use in a trade or business or for investment”.

This rule was based on the 1031 section of the IRS code and the term 1031 Exchange is a term that is used within the real estate business.   Now let’s take a look at how it works.

1. It will allow any taxpayer to defer the taxes on a property sale if it is exchanged one investment property for another similar type of  property that is being used for business or investment purposes

2. You will need to hire a real estate lawyer to apply the legal processes that are required in the 1031 Exchange

3. If you would rather, you can hire a Qualified Intermediary or QI as a third party that is independent of the process.  A QI will hold the profits from the sale of the first property that you sell until you are able to invest into another property or properties.  You should have a minimum of two properties involved in this transaction

4. You are not allowed to use your own home to qualify for the 1031 Exchange.  The 1031 Exchange only allows the exchange of one property for another of the like kind.  When I say like kind, it does not mean the condition of the property or the value of the property but only that they are similar in their types like one investment property for another investment property

5. There are two very strict timeline guidelines: the Identification Period and the Exchange Period.  These dates cannot be extended to meet your needs and the process has to be completed within the time that is allowed by the IRS to take benefits out of complimentary tax treatment

• Identification Period = 45 days from the actual date you sell your property and the time you view the new property that you want to buy

• Exchange Period = 180 days from the classification date up to the closing date.  During this time you must get through the entire exchange process

Your best bet is to find a realtor who is very familiar with the 1031 Exchange tax code and dealing with investment properties.  The 1031 Exchange can be very beneficial to you; however, you will have to make sure that you do everything accordingly.   The only way you can make sure of this is if you have a realtor and a real estate lawyer to handle the proceedings for you.

How To Protect Yourself From Real Estate Fraud and Foreclosure Rescue Scams.  With the number of growing foreclosures has come another breed of criminal.  They claim to be foreclosure rescue specialists and they could cost you thousands of dollars and quite possibly your home.

The best way to protect yourself from real estate fraud and foreclosure rescue scams is to hire a realtor and a real estate attorney!  Why would you want to take a chance on such a big event in your life.   A realtor will know the indicators of a “bad deal” and be able to advise you on how to avoid making a costly mistake.   Or at least know who to refer you to in order to get some legal advice.

The government has laws in place that require professionals to get a license within the practice of their profession.  So make sure you hire someone that is credible, trustworthy, experienced and loyal.   It is very important that you do not sign anything without having a real estate attorney look at it first.

A foreclosure rescue scam artist will make lots of promises they can’t keep like guaranteeing to save your home or lower your mortgage.  They will ask for a fee and claim that they are in direct contact with your mortgage service company.  Warning – they aren’t!

So here are a few things to look for in order to avoid a potential scam.

• Be wary of anyone that requires you to pay a fee in exchange for their counseling services or the modification of a delinquent loan

• If someone keeps trying to pressure you into signing the papers immediately

• Beware of people that say they can “save” your home and ask you to sign or transfer the deed to your house over to them

• Do not sign over the deed to your home to anyone unless you have been working directly with the mortgage company and they will be forgiving your debt

• Do not ever make a mortgage payment to anyone other than your mortgage company without your mortgage companies approval

If you find that you have been the victim of a real estate scam or a foreclosure rescue scam then you should file a complaint with the Federal Trade Commission (FTC).  You can file a complaint online or you can call them at 1-877-FTC-HELP (1-877-382-4357).  They offer assistance in both English and Spanish.
